These Terms of Use ("Terms") govern your use of the Saymico mobile application (the "Platform") made available by Saymico Inc ("Company", "we", "us" and "our"). The terms "you" and "your" refer to the user of the Platform. You agree to be bound by the Terms by using the Platform.

These Terms, the Saymico Privacy Policy, and Community Guidelines ("Platform Policies") will be read together. The Platform Policies set out the rules you are required to follow while using the Platform.

We may periodically update these Terms. Your continued use of the Services will constitute your acceptance of the updated Terms. We will notify you from time to time to update you of any material changes made to these Terms.

CHANGES TO SERVICES

Our Platform is dynamic and may change rapidly. As such, we may change the services we provide at our discretion. We may temporarily or permanently stop providing Services or any features to you generally. We may remove or add functionalities to our Platform and Services without any notice. However, if we make a change where your consent is required, we will make sure to ask for it.

WHO MAY USE OUR SERVICES

Our Services are intended for individuals who are 18 years of age or older. If you are under the age of 18, you are not permitted to use our Services. By using our Services, you represent and warrant that you are at least 18 years old.

PRIVACY POLICY

Our Privacy Policy describes how we handle the information you provide to us when you use our Services. You understand that through your use of the Services you consent to the collection and use of this information.

PURCHASE AND USAGE OF COINS AND GIFTS

Purchasing Coins

  • You may purchase virtual "Coins" through the Platform using a variety of payment methods.
  • The price of the Coins will be displayed to you at the point of purchase.
  • All purchases of Coins are final and non-refundable, except as required by law.
  • We reserve the right to change the price of the Coins at our discretion.

Usage of Coins

  • Coins can only be used on our Platform and as a part of our Services, and cannot be combined or used in conjunction with other promotions.
  • No Coins can be assigned or transferred to any other user of the Platform or a third party.
  • The sale, barter, assignment or other disposal of any Coins, other than by us, is expressly prohibited.
  • All Coins of a user will expire automatically upon termination of your account for any reason.
  • You agree that we have the right to manage, regulate, control, modify and/or eliminate such Coins without liability to you.

Purchasing Gifts

  • You can use the Coins to licence virtual gifts/digital goods ("Gifts").
  • You can gift these Gifts to other users of the Platform.
  • When you gift a Gift to another user, that user's profile will be credited with certain "Diamonds" (or similar reward credits).
  • These "Diamonds" can be redeemed for money or other forms of credit.
  • The rate of redemption will be determined by us and displayed to you at the point of redemption.

YOUR COMMITMENTS

a. Your Account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your mobile device. You agree to accept responsibility for all activities that occur under your account.

b. Your Conduct & Standards

You agree to use the Platform in a manner that is consistent with these Terms and the Platform Policies. You must refrain from engaging in any behavior which can be considered to be:

  • Discriminatory or involves hate speech, or incites violence.
  • Promotes gambling, online gaming, or money laundering.
  • Defamatory, invasive of another's privacy, or impersonates another person.
  • Relates to commercial activities (spam, junk mail, advertising).
  • Otherwise violates any laws in force.

c. Content Rights and Liabilities

You are solely responsible for all the content you post or share on the Platform. We do not claim any ownership of your content. However, by sharing content on the Platform, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content.

BROADCAST

The Platform provides a broadcast feature through which you can stream your audio and video content to other users on the Platform. You are solely responsible for the content you broadcast and any interactions you have with other users during the broadcast. We reserve the right to monitor broadcasts and remove any content that violates our Terms or Community Guidelines.

WHAT HAPPENS IF WE DISAGREE

If you are unhappy with our Services or have any disagreements, we hope that you will first reach out to us at care@saymico.com so that we can try and resolve the issue.

LIMITATION OF LIABILITY

We do not represent or warrant that the Platform or the Services will be error-free or uninterrupted, or that the Platform or the server that makes it available is free from any harmful components. In no event shall Saymico, its directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages.

TERMINATION AND SUSPENSION

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without any notice, if we believe that you have violated any of these Terms or the Platform Policies.
